1. 추방절차 Removal Proceedings 의 정의
추방절차 (Removal Proceedings)란 미국법에 정의된 불법체류자(Unlawful Presence), 체류신분위반자(Unlawful Status), 부도덕(Moral Turpitude) 한 행위를 한 자, 망명자(Asylee), 난민(Refugee)을 대상으로 한 미국체류적격(適格)심사 및 심사결과로 발생하는 미국체류자격 부여, 추방의 유예, 추방의 결정과 관련된 모든 절차를 말한다.
2. 추방절차 Removal Proceedings 의 유형
추방절차는 미국이민법에 정의된 바에 따라 아래에 설명하는 7가지의 유형으로 진행될 수 있다.
- 일반적인 추방절차 Regular Removal Proceedings: 이민국(원고)에서 미국체류적격심사 대상자(피고) 에게 이민법원 출두 통지서(NTA, Notice To Appear)를 발부하고 그 내용으로 이민법원에 피고의 추방을 청구하면서 피고의 추방을 위한 법원심리(審理)를 시작함.
- 법원심리 없이 추방하는 절차Stipulated Removal: 추방대상자가 동의함에 따라 법원심리 없이 추방.
- 추방명령복원 Reinstatement of Removal Order: 과거에 추방명령을 받고 미국에 불법체류하는 자에 관한 추방으로서 법원심리 없이 추방. For such an alien, the prior order “is reinstated from its original date and is not subject to being reopened or reviewed.” The alien “is not eligible and may not apply for any relief” from removal and “shall be removed under the prior order at any time after the reentry.” These rules apply regardless of whether the alien is apprehended at the border or in the interior of the United States and is irrespective of how long the alien has lived in this country.
- 약식(略式)추방절차Expedited Removal Order (a summary deportation order): 법 집행관의 판단에 따른 법원심리 없이 추방.
- 중범죄(重犯罪, an aggravated felony)를 대상으로 한 추방절차Administrative Removal Proceedings: 시민권자가 아닌 범죄자를 대상으로 한 약식추방절차로서 법원심리 없이 추방
- ESTA(무비자)입국자를 대상으로 한 추방절차Administrative Removal for Visa Waiver Program Entrants: 입국심사시 무비자입국 부적격자로 판단되는 경우 법원심리 없이 추방
- 사전추방명령에 따른 추방Removal Based on a Prior Deportation Order: 과거에 추방명령을 받고 추방된 자가 미국에 불법입국을 시도하는 경우 법원심리 없이 추방
